Corps~le No. 199.881019 _ _ __ _ - _ _ ___ _ - . __ ~ _ _ <br />Deaz Mr. Brown : - <br />Reference is made to the above-mentioned portion of the M&G Pit located in the NE'/a of <br />Section 3, T2S, R67W, Adams County, Colorado. This 20.71 acre of the M&G Pit, which includes <br />isolated wetlands and open water is not waters of the U.S. <br />This 20.71 acre azea has been reviewed by Mr. Terry McKee of my office during his September <br />18, 2006 site visit. This visit was in accordance with Section 404 of the Clean Water Act under which the <br />U.S. Army Corps of Engineers regulates the dischazge of dredged and fill material, and any excavafion <br />activity associated with a dredge and fill project in waters of the United States. <br />Based on the information provided, a Department of the Army (DA) Permit will not be required <br />for work at the eastern 20.7I acre portion of the M&G Pit.
