Box 791 <br /> Boulder, CO 80306 <br /> RE: Request for copies of correspondence, Western Mobile, Deepe Pit, <br /> Permit M-81-302 . <br /> Dear Ms. Rouyer: <br /> I have received the City of Boulder's request to be provided with <br /> copies of correspondence relevant to the reclamation of Western <br /> Mobile's Deepe Pit. Unfortunately, the Division of Minerals and <br /> Geology cannot provide copies free of charge to anyone, since our <br /> budget does not allow this activity. I have, however, enclosed our <br /> policy statement on public access to public records and a request for <br /> information form that you can use if you wish. <br /> My suggestion would be to have yourself or a member of your staff come <br /> to our office and review the existing file for the Deepe Pit and mark <br /> the section(s) you want copied. We will then have those sections <br /> copied for you and bill you for the copying costs. Also, you will <br /> then have an idea of what is presently required of the operator under <br /> the existing reclamation plan. <br /> If Western Mobile attempts to change their reclamation plan to a <br /> significant degree, they will be required to file an amendment to <br /> their reclamation permit. If this is done, the public notice <br /> procedures of Rule 1. 6 of the Mineral Rules and Regulations (2 CCR <br /> 407-1) must be followed. This rule provides, in part, that the <br /> applicant must post notices at the location of the mine site, notify <br /> the Board of County Commissioners, notify the Board of Supervisors of <br /> the local soil conservation district, and notify all owners of record <br /> of surface rights to the affected land and all owners of record of <br /> lands that are within 200 feet of the boundary of the affected land. <br /> Additionally, the applicant must publish notice in a newspaper of <br /> general circulation in the locality of the proposed mining operation <br /> and post a copy of the application and any changes to the application <br /> with the Clerk and/or the Recorder of the county or counties in which <br />
