<br />shall be and remain the property of BMRI, Upon termination of this Agreement, or upon <br />the prior request of BMRI, Contractor shall deliver such work product and information to <br />BMRI. <br />13.2 Contractor shall not acquire any interest, direct or indirect, in any mining <br />claims, leases, mining rights or fee lands in the San Luis Gold Project Area, Costilla County, <br />Colorado without BMRI's prior written consent. Any interest acquired in v~~olation of this <br />Article, at BMRI's request and at no cost to BMRI, shall be conveyed to BMRI. <br />13,3 In the event of a breach or threatened breach by Contractor of this Article, <br />BMRI shall be entitled to a temporary restraining order or a preliminary injunction <br />restraining Contractor from using or disclosing, in whole or in part, amr information <br />furnished to Contractor by BMRI or BMRI work product, and Contractor consents to the <br />entry of such a temporary restraining order for preliminary injunction without the necessity <br />of BMRI posting any bond in connection therewith, and agrees that it shall not assert any <br />defenses to any petition filed by BMRI in a court of competent jurisdiction requesting such <br />temporary restraining order and/or preliminary injunction, as the case may be. Nothing <br />herein shall be construed as prohibiting BMRI from pursuing any of the remedies available <br />to it for such breach or threatened breach, including the recovery of damages from <br />Contractor. Contractor shall use its best efforts to prevent disclosure of any information <br />furnished to it by BMRI or BMRI work product unless authorized by BMRI to so disclose <br />_22_ <br />
