Dear Mr. Mount:
We are responding to your written request for comment on the
Oldcastle SW Group, Incorporated (d.b.a. S &.~ Excavating) at the
Montgomery Pit under Permit No. M-1986-104. The project site is
located near the Eagle River within Section 1, Township 5 South,
Range 85 West, Eagle County, Colorado.
Additionally, this correspondence serves to notify you of
three important aspects for your future 112 considerations:

2. Enclosed is a map depicting areas of responsibility for
our office regulatory project management staff. Please use
this information for your future 112 considerations and
requests for review.
3. It has taken approximately 49 days for the Department of
the Army to scan, authorize, load and utilize the Quickview
software you require for review of materials submitted to
this office. Not all of our office staff have been provided
administrative rights for the installation of your software.
In consideration of this federal agency interest review for
the above-mentioned permit amendment, and in accordance with
Section 404 of the Clean Water Act, a Department of the Army
permit is required for any discharge (including mechanized land
clearing) of dredged or fill material in waters of the United
States. Within the context of Section 404, "waters of the United
States" are defined as the territorial seas; perennial and
ephemeral streams; lakes, ponds, impoundments; and wetlands.
Federal-law',requires that- any iridididual"or.entity proposing to
discharge into waters of"the-United States obtain a.Department of
the Army permit prior'to commencing such work. 01ir review has
determined that waters of the U.S. are present at this site.
