S &.~ Excavating) at the <br />Montgomery Pit under Permit No. M-1986-104. The project site is <br />located near the Eagle River within Section 1, Township 5 South, <br />Range 85 West, Eagle County, Colorado. <br />Additionally, this correspondence serves to notify you of <br />three important aspects for your future 112 considerations: <br />1: Mr: .Grady McNUre no longer is the contact`person for' <br />. this office. Mr._Ken'Jacobson is,the "office Chief fo'r°the <br />• Colorado/Gunnison'-Basin'Regulato'ry.Offic'e': <br />2. Enclosed is a map depicting areas of responsibility for <br />our office regulatory project management staff. Please use <br />this information for your future 112 considerations and <br />requests for review. <br />3. It has taken approximately 49 days for the Department of <br />the Army to scan, authorize, load and utilize the Quickview <br />software you require for review of materials submitted to <br />this office. Not all of our office staff have been provided <br />administrative rights for the installation of your software. <br />In consideration of this federal agency interest review for <br />the above-mentioned permit amendment, and in accordance with <br />Section 404 of the Clean Water Act, a Department of the Army <br />permit is required for any discharge (including mechanized land <br />clearing) of dredged or fill material in waters of the United <br />States. Within the context of Section 404, "waters of the United <br />States" are defined as the territorial seas; perennial and <br />ephemeral streams; lakes, ponds, impoundments; and wetlands. <br />Federal-law',requires that- any iridididual"or.entity proposing to <br />discharge into waters of"the-United States obtain a.Department of <br />the Army permit prior'to commencing such work. 01ir review has <br />determined that waters of the U.S. are present at this site. <br />
