III IIIIIIIIIIIIIIII <br />Foidel Creek Mine, C-82-056 <br />NOV-C-99-003 <br />The NOV was issued on April 12, 1999 for failure to pass mine water discharge through a <br />treatment facility, failure to conduct underground mining operations as described in the approved <br />PHC in the pernrit, and failure to prevent violation of federal water quality effluent limitations. <br />The operator submitted water analysis that demonstrates the dischazged water did not meet federal <br />effluent limitations. Discharge flows to Fish Creek. <br />Map 26: Explain how mine dewatering system is set up. <br />3/17/99: Twentymile Coal Company called DMG of a waterline break at the Fish Creek <br />Borehole. Twentymile Coal Company informed us that they did not think that <br />water had entered Fish Creek, but that water had appeared to be seeping through <br />the toe of the berm of an SAE. Twentymile Coal Company indicated they had shut <br />off pumps and they collected water samples. Twentymile Coal Company notified <br />CDPH&E of this break. <br />Subsequently, DMG decided to wait to inspect until we receive the water sample <br />analyses. <br />3/23/99: Twentymile Coal Company called DMG to inform us that the Fish Creek Borehole <br />pump was turned on 3/22/99 afrer repair of the pipe. Twentymile Coal Company <br />discovered a water line leak on the morning of 3/23/99. Water was running from <br />the break in the waterline, to the SAE, seeping under the toe of the berm and <br />Twentymile Coal Company informed DMG that a breach in the SAE berm had <br />occurred, indicating discharge of mine water into Fish Creek.. Twentymile Coal <br />Company stated that they had taken another water sample and notified CDPH&E <br />of this second spill. <br />3/30/99: In discussions with Twentymile Coal Company, DMG was informed of a third <br />waterline leak that had occurred on 3/30/99. Twentymile Coal Company stated <br />that this leak flowed to a different SAE, and had not flowed to Fish Creek. <br />Twentymile Coal Company did not collect water samples and did not notify <br />CDPH&E. <br />4/1/99: DMG conducts an inspection of the Twentymile Coal Company Fish Creek <br />Borehole site. Pump was turned off. Twentymile Coal Company was repairing <br />the waterline. Discharge from the treatment ponds was occurring. DMG sampled <br />NPDES pt. 001 discharge, and Fish Creek upstream and downstream of the <br />permitted discharge. The waterline breaks mentioned previously had been <br />repaired. <br />The breach in the berm had been repaired. Rills in the bank of Fish Creek <br />indicated that water had flowed from the breach to the creek. The breach was <br />approx. ] 0 ft. from the edge of the creek. Small puddles of water remained in the <br />SAE azeas. <br />
