_~_ <br />CEASE AND DESIST ORDER <br />Based upon the foregoing Findings of Fact and Notice of Violation, and <br />pursuant to the provisions of C.R.S. 34-32-123, the Board hereby orders you to: <br />1. Immediately cease and desist all excavation activities of the mining <br />operation. <br />2. Mail, within one (1) day after receipt of this Notice, to the Mined Land <br />Reclamation Board, written notice of your compliance with paragraph one (1) of <br />this Cease and Desist Order. <br />3. Submit a complete mining and reclamation permit application to the <br />Division by December 11, 1992. <br />4. Obtain a Mining and Reclamation Permit from the Division by <br />January 11, 1993. <br />5. Pay a civil penalty of $500.00 to the Mined Land Reclamation Board within <br />30 days of the date of this document. The Board will suspend $250.00 of the <br />civil penalty if corrective actions are completed by the specified dates. <br />In clarification of the rights of recipients of Notices of Violation, Cease <br />and Desist Orders, parties are advised to consult the Colorado Mined Land <br />Reclamation Act and the State Administrative Procedure Act. <br />Nothing herein contained, particularly those portions requiring certain acts <br />to be performed within a certain time, shall be construed as a permit or <br />license to engage in any prospecting or mining operations within the State. <br />Persons concerned with judicial review of the provisions of this Order are <br />advised to consult C.R.S. 24-4-106, as amended. <br />Dated at Denver this 24th day of November, 1992. <br />MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br />MICHAEL B.
