Canany <br />Division Director <br />Natural Resource Trustee <br />RE: Colorado Marble LLC, Lily Mines, Permit No. M-1987-028 <br />Response to Issues Related to Reclamation <br />Dear Mr. Holloway, <br />The Division of Reclamation, Mining and Safety received your letter regarding issues related to - <br />reclamation at the Lily Mines on September 28, 2006. Based o75 this letter, and at your request, the <br />Division conducted a site inspection to further discuss what reclamation measures maybe taken at <br />the site in lieu of the Cease and Desist Order issued by the Mined Land Reclamation Boazd. <br />In response to your letter, the Division has the following response to the reclamation tasks; <br />Backfill the unpermitted road on US Lime property. This activity would be allowed <br />since this would decrease the reclamation liability on site. <br />2. Grade in new road to upper mine workings. This activity is not allowed since this would <br />most likely increase the reclamation liability on site. <br />3. Channel Taylor Gulch with additional rip rap to insure separation behveen disturbed <br />area and the gulch. This task would be allowed and probably required under the <br />temporary stabilization plan. <br />4. Re-work grade on lower mine pad to ensure drainage rLtns into the pit. This task v/ould <br />be allowed and probably required under the temporary stabilization plan. <br />5. Re-do the silt fence previously installed to eliminate DMG concerns regarding previous <br />failure. This task would be allowed and definitely required under the temporary <br />stabilization plan, <br />6. Hauling stack piled rock from the pit area (mined in previous years) do7cn to the lower <br />pad (disturbed area included in the mine plan). This task would not be allowed unless <br />they take stockpiled material that was already mined and hau[ it down to the plant site <br />and this activity decreases the reclamation liability at the site (If it increases the <br />reclamation liability it is not allowed and if there is a question on who owns the material <br />it would not be allowed on legal right of entry questions). Therefore, only the stockpiled <br />Office of - Office of <br />Mined Land Reclamation Actlve and Inactive Mines <br />
