contaminants will be immediately cleaned up and reported to appropriate _- _ _ , <br />agencies. <br />~53~Colorado Mazble, Inc., is awaze of the discrepancy between its request for <br />operating season vs. Colorado Division of Wildlife statement. Colorado Mazble <br />is drafting a letter to COW requesting their review and re-consideration of the <br />extended season timetable. From discussions with local wildlife officials, it is <br />apparent that no special calving grounds, herd density (or presence of a herd), bird <br />or small mammal special zone consideration is applicable to this site. Colorado <br />Mazble will contact the Division of Wildlife to see if reclamation plans can be <br />devised in the best interest of wildlife habitat protection and/or improvement <br />,54~Colorado Mazble will await the Division's calculation of reclamation costs based <br />on information submitted in the application. <br />Chaffee County Special Use Permit requires a copy of the complete Mined Land <br />~p Reclamation Permit Application as the main document for Planning and Zoning <br />review and consideration. A copy of the amended application including this <br />correspondence will be forwarded to Chaffee County as soon it is completed. <br />It has been confirmed via recent survey work that the staging area is Forest <br />~- Service land. A Mill Site Claim was filed on this 3.17 acre parcel in December, <br />2005. Legal Right to Enter this pazcel is being developed via process determined <br />by Forest Service policies in accordance with federal guidelines for development <br />on mineral properties on federal lands <br />yi. Colorado Mazble, Inc, is actively engaged with Forest Service personnel, who <br />~~ have not yet determined their position in relation to the un-patented mining claims <br />filed by Colorado Mazble in September, 2005. We hope to have FS determination <br />and an action plan in hand by mid-August for proceeding with NEPA process on <br />the federal lands in question. <br />~,~ ~. Colorado Marble, Inc., is not awaze of encroachment of existing easements by <br />mining operations. It will continue to research this area and report to DMG on <br />any new information received. <br />Colorado Historical Society notation has been considered. The Garfield Mine site <br />is located along the FS 228 roadway one half mile south of the mining zone and <br />will not be impacted by mining or haulage operations. A structures letter will be <br />signed with the mining claim owner to insure that commitment from Colorado <br />Mazble to the land owner. The Lilly Mine lies above and east of the affected land <br />boundary east of Taylor Gulch. Mining operations will have no impact on the <br />remnants of the Lilly Mines operation, the sole remaining structure being the mill <br />building which is presently severely deteriorated by weather and decomposition. <br />
