Box 597 <br />Kiowa, CO 80117 <br />Dear Sir: <br />The purpose of this letter is to bill the county for damages incurred on <br />my property as a result of flooding caused mostly by the collapse and wash-out <br />of the Fondis Pit haul road on July 9, 1990, and again on May 19, 1991. Also <br />be advised that the Corps of Army Engineers directed the county to remove erosion <br />deposits in Spring Branch by March 10, 1991, and this was never done (Code 402 <br />violation). On May 19, 1991, these deposits were washed downstream and re-deposited <br />on private lands. <br />These two floods caused severe damage to my road, pond, wetlands and wildlife <br />habitat. They tore out my fences and uprooted trees, bushes, and turf that will <br />cause severe erosion in the stream bed. <br />If the commissioners question my loss and your liability, I would be pleased <br />to submit this claim to arbitration. <br />Sincerely, <br />James R.
