CO 80203 <br />RE: Mined Land Reclamation Division's (MEAD) Response to Ten-Day Notice <br />(TDN) No. 90-02-244-5, TV1, Trapper Mine, Trapper Mining Company <br />Dear Mr. Matthews: <br />In accordance with 30 CFR 842.11, the following is a written finding <br />regarding MLRD's response to the above TDN: <br />On November 6 and 7, 1990, the Albuquerque Field Office (AFO) conducted <br />a random sample oversight inspection of the Trapper Mining, Inc., <br />Trapper Mine. The Office of Surface Mining and Reclamation and <br />Enforcement (OSM) inspector was accompanied by an MLRD representative. <br />The inspection resulted in the issuance of the above TDN dated November <br />13, 1990. The TDN was sent by certified mail and received by MLRD on <br />November 15, 1990. MLRD's written response is dated November 16, 1990. <br />AFO considers this a timely response to the TDN. <br />In violation 1 of 1, the TDN cites Colorado Rule 2 CCR 4.07-2, Section <br />4.08.5(8), as the regulation believed to have been violated. The TDN <br />states that the operator failed co maintain blasting records of its <br />overburden and coal shots for a 3-year period. Delay sketches were not <br />recorded in the shot records. <br />MLRD's response to the TDN indicates that the operator provided <br />additional evidence within the 10-day period, following the issuance of <br />the TDN, that sketches exist for all shots at the mine during the <br />3-year period preceding the inspection. Those sketches reportedly now <br />show the number of holes, burden, spacing, and delay patterns as well as <br />decking. MLRD declined to issue a violation in regard to the alleged <br />violation in the TDN based on that information. <br />
