Kerr-McGee Rocky Mountain <br />Corporation and Kerr-McGee Gathering LL.C (collectively "Kern-McGee") hereby <br />submit their objections to the proposed application. <br />Ken-McGee owns interests in several oil and gas leases covering the Application <br />Lands and currently operates the Rocky Mountain Coors Gas Unit #2 Well and <br />associated production facilities located in the SW/4NW/4 of Section 1, which lies within <br />the Application Area. In addition Kerr-McGee also has rights pursuant to its leasehold <br />interests to drill future wells within the Application Area at locations authorized under <br />the regulations of the Colorado Oil and Gas Conservation Commission. <br />Although the plats as submitted to Kerr-McGee do appear to carve out a small <br />area around Kerr-McGee's Rocky Mountain Coors Gas Unit #2 Well, the plats do not <br />show the proximity of the Applicant's proposed mining operations in relation to such <br />well. Kerr-McGee is concerned rhar rhP An„hgant hoc nn( prnvirjPrl ~n ali en1i~afa D'.'_m•':?.w <br />area in its plan to protect the integrity of this existing well or for Ken-McGee to maintain <br />and service this well in a safe and prudent manner. <br />In addition to the existing well, Kerr-McGee is also legally entitled and currently <br />has plans to drill future wells and to construct gas gathering pipelines, tank batteries, <br />heater/treaters and related facilities ("Facilities") on the Application Lands. The <br />Applicant's plan does provide for a setback area in the SE/4NE/4 of Section 2, however <br />once again, from the plats provided, it is difficult to ascertain the proximity of the <br />Applicant's proposed mining operations in relation to any such future well and Facilities. <br />Moreover, this setback area does not appear to be a legal well location in the SE/4NE/4 <br />of Section 2. Finally, the Applicant's plan fails entirely to provide for future wells and <br />related Facilities which Kerr-McGee is legally entitled to drill and construct in the <br />E/2SE/4 of Section 2 or for an additional well in the SW/4NW/4 of Section 1. <br />Gasf 04,~<d <br />i-3/-oz <br />
