• • iii iiiiiiiiiiiu iii <br />999 <br />Assessment Conference <br />This assessment conference is being held for NOV C-95-016 which was <br />issued to Mountain Coal Company on May 26, 1995 for three items <br />including: <br />1. Failure to construct and Maintain appropriate and REQUIRED <br />sediment control measures to reduce erosion and to control <br />sediment <br />2. Failure to maintain required ditches (channels) to convey <br />runoff from the fill surface <br />3. Failure to separately remove and segregate all topsoil prior <br />to disturbance of areas affected by mining operations <br />Specifically, for item l a silt fence is required to be installed <br />at the Lone Pine Gulch ventilation shaft and development waste pile <br />to control erosion and treat runoff from this site. A site <br />inspection was conducted on April 25, 1995 which revealed that the <br />silt fence was not properly installed by not being keyed into or <br />anchored into the soil. The operator was informed of this and <br />agreed to properly install the silt fence. During a follow-up <br />inspection conducted on May 10, 1995, the area below the fan site <br />had been re-installed but the waste pile silt fence was still not <br />properly keyed into the soil. Therefore, part one of the violation <br />was issued. PHOTOS <br />Also related to the waste pile, the diversion channels as required <br />by the permit and rule 4.10.3 and 4.09.2(7) were not being properly <br />maintained. These channels are required to safely convey water off <br />of the fill surface. PHOTO <br />The final item in the violation was written for failure to salvage <br />topsoil prior to disturbance. Material that was being disposed of <br />at the pile had been allowed to be placed on an area prior to <br />stripping topsoil. Basically what occurred is that the waste <br />material was spread out over a larger area than had been previously <br />prepared.
