35
1 or the other at this point. I don't know that
2 there's anything right now before the board that
3 even requires a ruling on whether Basin has
4 standing. I don't think there is, and I guess I
5 just don't advise the board to make a ruling
6 without a need to.
7 MR. PAULIN: Mike, what's your take?
8 MR. LONG: I guess I would defer to
9 Steve on that. I think the question is and what
10 Steve's asking is whether or not Basin had
11 standing, but the question stems from whether or
12 not Basin was adversely affected by the division's
13 determination.
14 Our belief was -- is that they were not
15 adversely affected, and I believe Steve is -- and
16 I'll let him make his own argument, but I believe
17 Steve is saying that for the record we believe that
18 since that was one of the original arguments made
19 that they didn't, and then the Court ruled on that
20 also that there should be a motion -- or at least
21 it should be discussed and then hopefully a motion
22 that goes in that direction.
23 And, Steve, I guess see if that's
24 correct. I don't want to put words in your mouth.
25 MR. BROWN: Yes, that's correct, Mike.
