All <br />6 they can do is speculate that at some point in the <br />7 future we might bring another NOV. Well, gee, <br />8 that's the way it is and every coal company has <br />9 that problem -- that potential problem. <br />10 So I don't want to say this too many <br />11 times, but I think the board does need to decide <br />12 today whether Basin has been adversely affected by <br />13 the vacation of the NOV, assuming you reinstate the <br />14 NOV, and make that determination. If they have not <br />15 been adversely affected, Mr. Anderson's line of <br />16 questioning is totally irrelevant to this <br />17 proceeding. <br />18 MR. PAULIN: Mr. Brown, this board <br />19 has -- we can vacate the April -- this is Ira <br />20 Paulin. We can vacate the April 10th order, or we <br />21 could do nothing and leave it in the district court <br />22 in Las Animas County.
