12
1 Mr. Brown's input, I do believe that for the
2 purposes of the question of whether the motion that
3 has been made so far is complete, yes, the Court
4 did discuss standing; yes, it was at issue before
5 the Court.
6 However, it was -- while it was
7 something on the table back in March when this
8 board made its decision, it was not a matter that
9 was addressed in the previous order, and I don't
10 believe that in order to vacate that order, if
11 that's what the board wishes to do, that that issue
12 even needs to be discussed.
13 If the board wishes to take it up as a
14 separate matter, that's fine. There's no reason
15 not to, but I don't believe it's necessary in order
16 to vacate the order.
17 MR. JANOSEC: Mr. Chair, I prefer to see
18 the motion stand the way it is.
19 MR. PAULIN: Okay. Scot.
20 MR. ANDERSON: Scot Anderson for Basin.
21 What I'd like to do is pose a few questions to Mr.
22 Berry, and then after that I'll just go ahead and
23 make my arguments about why you should let your
24 previous decision stand, if that makes sense.
25 MR. PAULIN: That's fine.
