Cattany <br /> Acting Division Director <br />RE: Lykins Gulch; Permit No. M-2000-090 <br />Notice of Possible Violation <br />Dear Mr. Loukonen: <br />On June 13, 2002 the Division of Minerals and Geology conducted an inspection of [he Lykins Gulch Quarry, Permit <br />No. M-2000-090 and found the following: <br />A portion of the rock waste pile located in the South Quarry is outside of the permit boundary area for an approximate <br />azea of 15 feet wide and 250 feet long. In addition, the operator constructed a staging azea approximately 1 acre in size <br />outside the permit area to store rock pallets and mining related equipment. <br />Based on the site inspections and review of the file, the Division believes the Operator to be in possible violation of <br />C.R.S. 34-32.5-116(1) and 34-32.5-116(4)(1) of the Colorado Land Reclamation Act for the Extraction of Construction <br />Materials for failure to perform the mining prescribed by the plan and failure to protect areas outside the permit area from <br />slides or damage during the mining and reclamation operation. <br />The Division will scheduled this matter before the Mined Land Reclamation Boazd. <br />A Formal Public Hearing will be held during the July 24-25, 2002 Boazd meeting for consideration of possible violation. <br />The hearing will be held in Room 318 of 1313 Sherman Street, Denver, Colorado, beginning at 10:00 a.m, on the 24`h <br />and 9:00 a.m. on the 25's or as soon thereafter as the matter can be considered. At that hearing you will have the <br />opportunity to be represented and heazd. It will be reiterated that there is reason to believe that you are in violation of <br />the provisions noted above. <br />If the Boazd finds a violation at this hearing, it may issue a Cease and Desist Order, assess a Civil Penalty in the amount <br />of $100 to $1000 for each day of violation, andlor order the permit be suspended, modified, or revoked. If you have <br />evidence indicating [hat [he possible violations noted above do not exist or have been corrected, please provide it [o us <br />as soon as possible or bring it to the hearing. <br />If you have any questions, please contact Erica Crosby. <br />Since ely, <br />Ron C.
