<br />BEFORE THE MINED LAND RECLAMATION BOARD <br />STATE OF COLORADO <br />FINDINGS OF FACT, CONCLUSIONS OF LAW. AND ORDER <br />[N THE MATTER OF LOUKONEN BROTHERS. THE HELSINKI QUARRY S[TE. FILE NO. M-81-277, <br />REQUEST FOR E;CEIviPTiON OF CERTAIN PROPERTY FROM CURRENT 112 PERMIT <br />APPLICATION <br />THIS MATTER having come before the biined Land Reclamation Board ("the Board") on July 27. 1999, fur A <br />hearing, [he Board makes the following Findings of Fact and Conclusions of Law, and enters [he following <br />Order: <br />FINDINGS OF FACT AND CONCLUSIONS OF LAW <br />I. Loukonen operates a gravel pit in Boulder County, Sec. 6. T3N. R70W, 6th P.M., pursuant to <br />110 permit no. ht-81-277. Loukonen is currently in the process of converting its 110 permit to a 112 permit to <br />expand reclamation to cover a larger area. <br />2. In November of 1998, a modem survey of the LarimerBoulder County line adjoining the <br />Helsinki Quarry site revealed that the site extended over the line into Larimer County. Previously, it was <br />thought, based on property line surveys from the 1800's, that the site was completely within Boulder County. <br />3. Loukonen appeared before [he Board to request that the 0.7 acres of the site in Larimer <br />County be exempted from the current 1 12 conversion application being considered by the Division. Loukonen <br />wishes not to undergo project review in two different counties, and also states that the area in Larimer County <br />will be reclaimed and returned to beneficial post-mining land use. <br />ORDER <br />Based on the above findings of fact and conclusions of law, the Board hereby GRANTS Loukonen's request <br />for an exemption of the 0.7 acres in Larimer County from the current 112 conversion application process on <br />the condition that Loukonen reclaims the affected areas of the site to the satisfaction of the Division. <br />Dated thiS~Q day of August, 1999 <br />COLORADO MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br />FOR THE BOARD <br />B Y: <br />MICHAEL B.
