Commodity: Sand and Gravel <br />Location: One mile north of Lamar, Prowers County <br />Date: May 22-23, 1985 <br />Specialist: Camille M. Farrell <br />Nature and Duration of Violation <br />- Failure to salvage topsoil, as specified in the Permit No. 81-132. <br />- The pit was excavated in 1981; approximately 2.24 Acres were disturbed. <br />- Further excavation occurred during 1983-84; an additional .5 Acres were <br />disturbed. <br />- The Division's staff estimates that two days were required for topsoil <br />removal. <br />Environmental Damage (I,M,S)* <br />Insignificant. <br />If further mining does not ensue, additional disturbance would be required to <br />obtain adequate amounts of topsoil to reclaim the presently disturbed area. <br />This operation is presently operated less than 180 days per year; the <br />possibility exists that further mining will not occur. <br />Safety Hazards (I,M,S)* <br />Insignificant hazard. <br />Willfullness (Negligent or Willful) <br />Willfull; the operator agreed to allow the previous landowner to remove <br />overburden (from which topsoil was not segregated) as a provision of the <br />land sale agreement. <br />Cooperation (Initiation of Appropriate Corrective Action) <br />Mr. George Gregg was cooperative; however, no corrective action has been <br />suggested. <br />Other sites and Previous Compliance Problems <br />See attached sheet. <br />
