1 a travesty. I do think we need a clarification of
2 that at some point.
3 MR. EVANS: I might suggest, if Z may,
4 Mr. Chairman, that the rule itself attempts to help
5 the Board in determining what constitutes a serious
6 unforeseen circumstance, by providing an al'cernative
7 that says there is so much snow cover that a proper
8 inspection may not occur. In this case there were
9 four inspections after the permit was made :ind before
10 the hearings.
11 CHAIRMAN DANIELSON: Thank you.
12 MR. EVANS: So that a seriou:a
13 unforeseen circumstance such as that would certainly
14 fit within the definition.
15 CHAIRMAN DANZELSON: Anything else
16 from the Board? Okay. I would then make my motion.
1T based on what I view, at least, as serious unforeseen
18 circumstances, provided by the statute, thi:> matter
19 be continued to the next Board meeting. I riould note
20 that will jest about exhaust our legal authority to
21 continue things so it wil'_ have to be heard, the-,
22 regardless of what happens. But at any rate' _T would
23 move that we continue this matter until that: date and
24 that at that time we consider all foLr issues, and if
25 the staff still believes t!:at there is a violation,
5U
MrDycmm pcopoTING SERV?CE
(303) 424-2217
