Dear Mr. Comer:
This letter responds to your letter of January 10, 2001, in
which you continue to advocate Powderhorn's request for an
additional 60 days beyond January 16, 2001 to obtain a
reclamation performance bond to replace the Frontier bond.l
I.
The Division of Minerals and Geology ("DMG") will extend
the time to abate the Notice of Violation ("NOV"} to close of
business March 19, 2001, but only upon the express understanding
that Powderhorn will promptly provide the information requested
in this letter.
Under its regulations, DMG cannot grant abatement more than
90 days after the NOV was issued. See, 2 C.C.R. ~ 907-2, Rule
5.03.2;2). That is, abatement be comple*_e by close of business
March 19, 2001.
The NOV will be deemed abated only if the substitute surety
from whatever source or combination of sources is in place --
together with any required Bankruptcy Court approval -- by close
