In 1978 the East Bay 1lunicipal <br />Utility District (EBnUD) built a dam and a series of ponds to <br />contain AHD flows. However, this system }ias been unsuccessful. <br />in part because the impoundments were constructed oC materials <br />which themselves generate AnD. Iliave been responsible far <br />evaluating the yeocliemical condition at the site and working this <br />evaluation into written testimony, declarations and reports in <br />preparation for two law suits 6rouglit by SCLDF: request Cor <br />denial of an exemption under California's Toxic Pits Cleanup Act: <br />and violations of t}ie Federal Clean Water Act. I testified at an <br />administrative hearing as an expert witness on the geochemistry <br />of the site, especially on acid mine drainage generation, the <br />geochemistry of the site before and after construction of the dam <br />and impoundments, and alternative remediation and treatment <br />methods that were not considered by EBnUD. I also testified at <br />an oversight investigation by the California State Senate in <br />January 1992. <br />Job: Preparation of natural Resource Damage claim For groundwater <br />injury in Butte, nontana <br />Client: State of Montana, State Attorney General's Office <br />Contact: Robert Collins, Special Assistant Attorney General, <br />natural Resource Damage Program <br />Summary: the State of nontana is preparing claims against ARCO <br />For natural resource damages due to mining in the Butte area, <br />which currently has four Superfund sites (three related directly <br />to mining) and has seen extensive mining far copper, gold and <br />silver far Doer a century. I am responsible for preparing the <br />groundwater report for the Butte area and am also available to <br />provide expert advice to those preparing the surface water <br />reports.
