Stxt. § 34-33-128(3),Jim and Ann Tatum ("the Tatums") havc moved <br />this Court for "temporary relief' from the "Final Board Order in the Mallcf of the Board's <br />Consideration of an Objection lu the Withdrawal of the }Tearing on Notice of Violation Nu. CV- <br />2000-009." !n that order, the majorih~ of a divided Colorado Mined Land Rcciamation Board ("the <br />Board") declazed that the OtTicc of Mined Land Reclamation in the Colorado Division of Minerals <br />and Geology ("DMG") - in this case, and this case alone - "did not have the authority to vacate the <br />NUV [Notice of Violation Nu. CV-2000-009] without prejudice." 1'he Board majority then <br />
