Walter Wise <br />Battle Mountain <br />333 Clay Street <br />42nd Floor <br />Resources, Inc. <br />Houston, TX 77002 <br />Re: Notice of Formal Public Hearing, Battle Mountain Resources, Irjc. <br />San Luis Project, File No. M-88-112 <br />Dear Mr. Wise: <br />On March 30, 1992 at a meeting of Division personnel and Matt Lewi Battle <br />Mountain Resources' Manager of Environmental Affairs, the Division was <br />informed that cyanide levels in the tailings slurry and in the tailings ponds <br />are significantly higher than stated in your reclamation permit. <br />We believe this is in violation of: <br />Section 34-32-124, Colorado Mined Land Reclamation Act, for failure to <br />comply with the conditions of your permit. <br />Therefore, we have found reason to believe a violation exists to P~rmit <br />M-88-112 and the Law and have scheduled this matter before the Min d Land <br />Reclamation Board. <br />A Formal Public Hearing will be held during the April 22-23, 1992 oard <br />meeting for consideration of possible violation. The hearing will be held in <br />Room 318 of 1313 Sherman Street, Denver, Colorado, beginning at 9: 0 a.m. or <br />as soon thereafter as the matter can be considered and you will ha a the <br />opportunity to be represented and heard. It will be reiterated th t there is <br />reason to believe that you are in violation of the provisions note above. <br />If the Board finds a violation at this hearing, it may issue a cea a and <br />desist order, assess a civil penalty in the amount of $100.00 to $1,000.00 <br />for each day of violation or order the permit be suspended, modifi d or <br />revoked. If you have evidence indicating that the possible violations noted <br />above do not exist or have been corrected, please provide it to us as soon as <br />possible or bring it to the hearing. <br /> <br /> <br />Continued discharge cf tailings slurry to the tailings dam with le~els of free <br />cyanide exceeding 4.4 ppm may result in a day of violation for eac day this <br />level is exceeded. <br />
