According to 5.09.3(21, the Division must <br />notify the person issued a Dlotice of Violation of the proposed amount of <br />civil penalty within 30 days after issuance (June 20, 19811. Due to an <br />error by the Division, the proposed amount for the civil penalties was not <br />sent. Since this date has passed, no civil penalties will be assessed for <br />81-17 and 81-19. No civil penalty will be assessed for 81-18 unless Blue <br />Ribbon fails to abate this violation, in which case the Division is requited <br />to issue a Cease and L~sist Order and assess a civil penalty. <br />I would like to emphasize that this was a procedural error. It is not <br />Division policy to issue violations without a subsequent civil penalty. Zn <br />the Future, if violations are issued to Blue Ribbon, civil penalties will <br />be assessed.
