.~ <br /> <br />NOV 13 '97 99~41AM DMG ~RNGO FIELD OFFICE • P.3i3 <br />sent certified letters to Telluride Mining Co., Inc. and Blake Mining Co. on September 9, <br />1997 granting a single sixty (60) day extension to November 12, 1997 to resolve the issue <br />of inadequate Financial Warranty. In this letter, the Division set forth specific <br />requirements that would need to be met in order for the Division to accept use of a DOE <br />bond to satisfy the Division's Financial Warranty requirements. <br />4. On October 6, 1997, the Division sent Ms. Sue Carter of Telluride Mining Co., Jnc. a <br />letter describing the current status of resolution of problems identified in the Division's <br />June ] 2, 1997 inspection report. This letter specifically identified the Financial Warranty <br />submittal issue as being unresolved, and reiterated that the issue needed to be resolved by <br />November 12, 1997. However, as of the November 12, 1997 extended due date, the <br />Division has not received a Financial Warranty from Telluride Mining Co., Inc. nor has the <br />Division received any information regarding possible use of a DOE bond to satisfy the <br />Division's Financial Warranty requirements. <br />As a result of this denial, Blake Mining Co. remains the current permittee and continues to be <br />responsible for compliance with the terms of the approved Reclamation Permit, the requirements <br />of the Act and Rules, and submittal of the increased Financial Warranty amount.. <br />You may appeal the Division's denial decision to the Colorado Mined Land Reclamation Board <br />by submitting a written request for Administrative Appeal to the Division within sixty (60) days of <br />the decision date (please refer to C,R.5.34-32-107 (2) and Rule 1.7.4). <br />If you have any questions, please contact meat the Division's Durango Field Office, 484 Turner <br />Drive, Bldg.
