SCHWARZ <br />303.893.0999 <br />jsc hwarz@m s sde nverlaw.com <br />RECEIVED <br />FEB Z 7 2002 <br />Division of Minerals and Geology <br />This letter follows up on my February 6, 2002 letter to Carl Mount <br />regarding the Revised Drainage Control Plan for the Howe Pit. Please find <br />attached a copy of plans entitled, "Mobile Premix Concrete, Inc., Bull Seep <br />Channel Relocation Plans, Adams County, Colorado," dated February 26, 2002 <br />(prepared by Applegate Group, Inc. on behalf of MPC). The plans meet with the <br />approval of the Urban Drainage and Flood Control District ("UDFCD") Task <br />Force. They update the Revised Drainage Control Plan submitted to your office <br />on January 11, 2002 in conformance with Section 2.A of the Mined Land <br />Reclamation Board's Order of October 26, 2001 and the DMG's letter of <br />November 27, 2001. We recommend that the plans be used to support the <br />Technical Revision ("TR") of the Permit No. M-78-052 as previously discussed <br />with Carl and referenced in my February 6 letter. <br />Mobile Premix should be in position to commence implementing the <br />improvements depicted in the plans as soon as the TR issues (but also pending <br />issuance of an amended Section 404 permit the Corps is processing, and flood <br />plain use permits Adams County and Commerce City either have, or will soon <br />issue). Since the Board's October 26, 2001 Order requires that the Bull Seep <br />relocation be completed by March 31, 2002, your expeditious review of the plans <br />and issuance of the TR would be greatly appreciated. <br />
