BANTA, Director <br />December 14, 1989 <br />T0: Fred Banta and Mike Long ~y <br />From: Mike Sae and David Berry <br />RE: Extension past 90 days for abatement for NOV C-89-031 <br />Based on David Berry's inspection of the Apex No. 2 Mine on November 11, 1989 <br />Notice of Violation C-89-031 was issued for failure to maintain the drainage <br />control system in accordance with the approved plan. Abatement step number 1 <br />was to, "Maintain the entire drainage control system so that all ditches and <br />culverts are clear of debris and so that all ditches are in compliance with <br />the dimensional requirements specified on Plate l." This was to be <br />accomplished by December 1, 1989. <br />On November 27, 1989 Mike Savage visited the site to check on progress of the <br />abatement. The operator had built up the berms to conform to the design <br />criteria. However, the culverts of concern had not been uncovered and <br />cleared. Ther had been a recent snowfall of approximately 8-10 inches. The <br />operator had contacted David Berry that week to inform him that the culverts <br />could not be located. The operator felt they had been deeply covered by <br />county road maintenance operations. Further, the operator stated that weather <br />conditions (primarily frost and snow depth) were preventing them from <br />completing that portion of the abatement. The operator requested in writing <br />that the deadline be extended. The on-site conditions were verified by David <br />Berry during an inspection conducted December 6, 1989. <br />At this time we would request concurrence of the Administator in accordance <br />with Rule 5.03.2(2)(e) for the extension of the abatement deadline to March 1, <br />1989.
