AGREEMENT <br />THIS AGREEMENT is entered into this2~ day (dated by Structure Owner) of <br />,u~ 2003, by and between Mountain Aggregates, Inc., (hereinafter <br />refer d to as the "Applicant") whose address is 2096 S. I-25, P.O. Box 535, <br />Castle Rock, CO 80104, and Colorado Department of Transportation. Propertv <br />Management, (hereinafter referred to as the "Structure Owner") whose address is <br />15285 S. Golden Rd., Bidg. 47, Golden. CO 80401. <br />The Applicant is seeking an Amendment to its State of Colorado Mined Land <br />Reclamation Board Permit # M-77-534 <br />the property as identified in the legal <br />depicted on the enclosed Location Map <br />to mine sand and gravel and to reclaim <br />description (see Attachment B) and as <br />(see Attachment C). <br />The Structure Owner owns a permanent man-made structure within 200 ft of the <br />land affected by mining and reclamation operations. The description of this <br />structure(s) is given as Attachment A. Attachments A, B and C are attached <br />hereto and made a part of this Agreement. <br />The Applicant hereby commits to fully repair or to fully compensate the Structure <br />Owner for any damage to the structure described in Attachment A caused by the <br />Applicant's mining and reclamation operations. <br />AGREED: <br />By the Applicant: <br />by <br />Mountain Aggregates.
