In a
conversation with Dan Hernandez today, he informed me of the nature of the violations,
the likelihood of then modificatioq the remedial measiues nocessary to abate each
violation, and the abatement deadlines.
Given the proposed modifications w the tenredial measiuzs for the notices of violation
and my recent retention to address the issues associated with the notices, I would
respectfully request as extension to the abatement deadlines for each of the notices of
violation.
For NOV CV 2000.002, issued for failure to provide a valid certificate of inamrnnr~ 5or
the mine, I would t~equest an extension to June 15, 2000. Dan Hernandez and I discussed
the apparem confirsion regarding the mailing address the insraarrce eo~any hag, the
necessity to modify the language on the in~~Mnrr• binder to satisfy CDMG [equu+ements,
and the requitement for a valid signature. I plan to centact the agent you have been
dealing with in the next several days to rectify these concerns. Ag I will be out of the
office next week, and the ages¢ is not in Cobrado, L anticipate the need for addctional
time to produce the tegwred document. It is my ,.n nnet'n that the mine has not been
without liabiiiry insurance coverage. but that documentation is not present and sufficient.
I will obtain that documentation and provide it to CDMG by Ju>x l5, 2000 if that
extension date is acceptable.
NOV CV 2000-003 was iggued for failure to maintain copies of rrocords and reports. If
acceptable to the Division, I would request an extension of the abatement deadline w July
10, 2000 (90 days from issuance of the NOV). As you are aware, some of the requested
information may not be avat7able, and I need to determine that which is and that which is
not I will also Deed some time to prepare the requested anmral reclamation report and
annual hydrologic report. I am also in the process of updating the required-records and
