STATE OF COLORADO <br />MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br />IN THE MATTER OF; Rio Grande County ) NOTICE OF VIOLATION M-95-055 <br />P.O. Box 46 ) AND <br />Monte Vista, CO 81144 ) CEASE AND DESIST ORDER <br />TO: Rio Grande County and all other persons engaged in or owning or controlling the following <br />operation: 374 Pit in Rio Grande County. <br />FINDINGS OF FACT <br />Pursuant to the authority vested in the State of Colorado Mined Land Reclamation Board by <br />C.R.S. 34-32-124, the Board hereby makes the following findings of fact: <br />1. Rio Grande County is permitted to conduct a mining operation under the terms of <br />Permit M-87-020 located in the SE/4, Section 21, Township 40N, Range 6E of the <br />New Mexico P.M., in Rio Grande County, Colorado. <br />2. The Mined Land Reclamation Board conducted a Formal Public Hearing on August 23, 1995 <br />to consider possible violation of the terms of Permit M-87-020 and C.R.S. 3432-101 et se . <br />3. The Division of Minerals and Geology presented evidence at the Formal Public Hearing on <br />August 23, 1995, demonstrating that: <br />a. Rio Grande County is conducting mining activities beyond the approved 9.92 <br />acre permit boundary of Permit No. M-87-020. <br />b. Rio Grande County has disturbed approximately 15.7 acres outside the <br />approved permit boundary. <br />NOTICE OF VIOLATION <br />Based upon these same Findings of Fad and in accordance with C.R.S. 34-32-124(6), the <br />Colorado Mined Land Reclamation Board hereby finds Rio Grande County to be in vio)ation of <br />Permit M-87-020, and C.R.S. 34-32-109(1), i <br />I <br />
