Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division of Minerals and Geology regrets to inform you that the outstanding application for <br />Amendment AM-01 is denied. Staff allowed ample time for requested information to be submitted <br />which was never received. By rule, you had 60 days to submit the information, which should have been <br />received by early March of 2005. A letter dated January 20, 2005 clearly outlined the requirements. <br />Clearly, the denial of the application is way over due. <br />The denial means that all fees are forfeited and the issue of disturbance outside your permit boundaries, <br />which was to be corrected, remains outstanding. Division staff will inspect the site in the next year and <br />if a new amendment is not submitted and approved by that time, staff will have no choice but to <br />schedule the matter for a public hearing which may include civil penalties, revocation of your permit <br />and forfeiture of your financial warranty.
