Cattany
Division Director
Natural Resource Trustee
The Division of Minerals and Geology regrets to inform you that the outstanding application for
Amendment AM-01 is denied. Staff allowed ample time for requested information to be submitted
which was never received. By rule, you had 60 days to submit the information, which should have been
received by early March of 2005. A letter dated January 20, 2005 clearly outlined the requirements.
Clearly, the denial of the application is way over due.
The denial means that all fees are forfeited and the issue of disturbance outside your permit boundaries,
which was to be corrected, remains outstanding. Division staff will inspect the site in the next year and
if a new amendment is not submitted and approved by that time, staff will have no choice but to
schedule the matter for a public hearing which may include civil penalties, revocation of your permit
and forfeiture of your financial warranty. We regret that we are placed in this position and now have no
leeway.
If you need additional information, please contact me at the Division of Minerals and Geology, Grand
Junction Field Office, 101 South Third Street, Room 301, Grand Junction, Colorado 81501, telephone
no. 970-241-1 117
Sincerely,
G.
