Rule 5.04.4(1) states that both the <br />written request for a public hearing and the amount of the fixed penalty must <br />be received by the Division within 30 days of the receipt by the operator of <br />the Notice and Order to Pay Fixed Penalty. According to the Division's <br />records, the Notice and Order to Pay Fixed Penalty for each of the three NOVs <br />was delivered on November 30, 1992. The request for a public hearing was <br />filed with the Division on January 4, 1993, five days past the deadline. In <br />addition, the check for the amount of the fixed penalty was inadvertently left <br />out of that January 4, 1993 submittal.
