.- <br />NOV C-93-118 <br />Somerset Mine <br />This NOV was issued for failure to follow required procedures <br />related to surface blasting operations. <br />HISTORY <br />Five NOV's were issued at this mine during the past twelve months. <br />They are NOV's C-92-033 and 034 and C-93-007, 032 and 068. $250 is <br />assessed for history. <br />SERIOUSNESS <br />Lack of advance notice of blasting has the potential for serious <br />impacts regarding public health and safety. However, the blast <br />cited in this NOV was small enough that the likelihood of any <br />physical damage to structures or people was all but nonexistent. <br />There is no evidence that the person conducting the blasting was <br />certified to use explosives on the surface. This is viewed as a <br />serious problem due to the potentially hazardous nature of <br />explosives use by untrained personnel. $1000 is assessed for <br />seriousness. <br />FAULT <br />The operator was negligent in not following required procedures <br />while conducting surface blasting operations. $250 is assessed for <br />negligence. <br />GOOD FAITH <br />Good faith is not applicable since there is no abatement for this <br />violation. <br />
