After reviewing the Pit #1 <br />area, which had not changed from the May 12, 1994, inspection, <br />Federal NOV # 94-020-352-003 was issued and delivered to Mr. <br />George Patterson who declined to sign the document. The NOV <br />was discussed in detail with Mr. Patterson who indicated that <br />he understood the nature of the violation and the remedial <br />work required. He was told that if he had any further <br />questions to contact AFO. <br />In addition to the Federal NOV Ten-Day Notice (TDN) # 94-020- <br />352-002 is being issued to the State of Colorado for the <br />failure to return those non-Federal lands associated with Pit <br />#1 to their AOC. <br />Because the remedial measures of the NOV require that spoil <br />from the permit area be transported to and backfilled in the <br />Pit #1 area further discussion regarding the reclamation <br />accomplished in other parts of the permit is premature. Other <br />areas of the permit will, in all likelihood, have to be <br />affected to obtain the needed spoil to accomplish the remedial <br />measures. <br />
