Section III - Status of Stipulations <br /> Twenty-five stipulations were attached to the September 29, 1981 Permit <br /> No. C-81-038. These stipulations and their status are listed below. <br /> Stipulation No. 1 <br /> Colorado Westmoreland, Inc. must obtain a letter from the State Historical <br /> Preservation Office within 30 days of the permit issuance stating whether <br /> or not there are any places located within the proposed permit area which <br /> are listed or eligible for listing in the National Register of Historic <br /> Places . <br /> Resolved: The State Historic Preservation Office sent a letter to OSM on <br /> October 2, 1981 , and it was accepted by the Division on December 2 , 1981 . <br /> Stipulation No. 2 <br /> Colorado Westmoreland, Inc. must submit to the Division in final form the <br /> Vegetation Inventory of the Orchard Valley Mine, as outlined in the draft <br /> vegetation inventory report by Harner-White Ecological Consultants , Inc. , <br /> dated August 6, 1981 . This final report must be incorporated into the <br /> permit application as part of the Vegetation Appendix in Volume 7. This <br /> report must be submitted to the Division within 30 days of the permit <br /> issue. <br /> Resolved: The Final Vegetation Inventory was received by the Division on <br /> March 2, 1982 and was accepted by the Division on March 31 , 1982. It is <br /> currently found in Volume 9A of the permit application . <br /> Stipulation No. 3 <br /> The operator is directed by the Division to install the monitoring network <br /> shown on Map 28B above the 5 north panel and the 8th east main prior to <br /> November 1 , 1981 . In order to determine the adequacy of the simplistic <br /> monument proposed for use in this network, the applicant shall install <br /> appropriate benchmarks to allow quarterly monitoring of the monument <br /> network for a minimum of nine months prior to mining within the subject <br /> panel . Prior to the installation of the monument network benchmarks , the <br /> operator shall obtain approval from the Division of the benchmark' s <br /> location and construction. Following receipt of that approval , the <br /> operator shall amend Map 28B to indicate the location of the approved <br /> benchmarks . <br /> Resolved: The subsidence monitoring network was proposed on December 4, <br /> 1981 and revised on February 2, 1982.
