<br />-2- <br />Understanding <br />Both parties Yiave~specific and separate statutory responsibilities to review <br />permit applications, monitor and inspect field sites, and take enforcement <br />action. Duplication and potential conflict between the parties exists in the <br />management of hydrologic balance and water quality issues with respect to the <br />responsibilities. This MOU addresses each area of responsioility separately. <br />Review of Permit Applications <br />MLRD and WQCD will coordinate the review of hydrologic information submitted <br />within a coal mining permit application with respect to information relevant <br />to Colorado Discharge Elimination System (CDES) permits for point source <br />discharges. The coordination will entail the following: <br />1. During pre-application meetings with potential coal permit applicants, <br />each agency will advise the applicant of the need to contact the other <br />agency. <br />2. MLRD will review the coal mining permit application to determine whether <br />the sediment control structures will be designed to meet technology <br />based effluent limitations. MLRD will transmit to WQCD their <br />determination as soon as the review of that particular part of the <br />application is completed. WQCD will consider the determination made by <br />MLRD during their review of the point source discharge permit <br />application. WQCD will review in detail the aspects of the mining <br />operation that are subject to the CDES permit requirements. Where <br />applicable WQCD will rely upon MLRD analysis to satisfy CDES <br />requirements. <br />MLRD and WgCD staff will confer, as appropriate, during the course of <br />the review to coordinate where there may be duplication or potential <br />conflict, and to keep each agency apprised of technical developments. <br />WQCD will provide MLRD with copies of all final ODES permits for coal <br />mines, and the copies of amendments to those permits as they occur. <br />Training <br />WQCD will provide training, as necessary, for MLRD inspectors in the proper <br />methods and techniques for the collection, transporting and delivery of water <br />quality 'samples. - <br />Inspections, Monitoring and Sample Analysis <br />MLRD and WQCD will coordinate inspections, monitoring and sample analysis in <br />the following manner: <br />MLRD staff will include in its field inspection procedures the <br />collection, when appropriate, of hydrologic data that may be used to <br />assess NPDES permit compliance. <br />
