This MOU satisfies concerns expressed by the <br />legislature, the mining community and the agencies about duplication of work <br />and potential conflicts between WQCD and MLRD. It describes a simple, ' <br />straight forward relationship which should be easily implemented and <br />manageable on a daily basis. <br />The MLRD inspection and enforcement responsibilities described in this MOU <br />require MLRD as part of its regular coal mine inspection program to conduct <br />appropriate field investigations related to water quality management and <br />report the results of the investigations to WQCD. Based upon information <br />obtained through the MLRD investigation, WQCD will analyze field samples and <br />make determinations about whether to initiate enforcement action under their <br />jurisdiction. This relationship provides a balance where MLRD is able to meet <br />its responsibilities under the Colorado Surface Coal Mining and Reclamation <br />ACt and WQCD is able to meet is responsibilities under the Colorado Water <br />Quality Control Act. In addition, the MOU describes the coordination that <br />will occur in the review of Coal Mining permit applications and Colorado <br />Discharge Elimination System Permit applications.
