CO-0029599 <br />PITKIN COUNTY, COLORADO <br />Pursuant to C.R.S. 5 25-8-603 and 5 C.C.R. <br />~ 1002-1-2.1.11, Snowmass Coal Company ("Snowmass"), by and <br />through its attorneys, Welborn, Dufford, Btown b Tooley, hereby <br />requests a hearing and submits its answer and detailed plan to <br />the Notice of Violation ("NOV") issued on August 1, 1986, <br />relating to the above-referenced water quality discharge permit <br />(the "Permit"). <br />ANSWER <br />1. Snowmass denies the allegations contained in <br />paragraph 1 of the NOV under the heading "Findings of Fact." <br />Snowmass operated an underground coal mine known as the North <br />Thompson Creek Mine No. 1 from 1977 until mining operations <br />were terminated in 1984. <br />2. In response to paragraph 7 of the NOV under the <br />heading "Findings of Fact," Snowmass admits that the sample <br />results listed in the NOV exceed the effluent limitations set <br />out in the Permit, However, Snowmass is without sufficient <br />information or knowledge at this time to attest to the <br />accuracy, propriety or validity of the collection, <br />c~ <br /> <br />
