<br /> <br />CHRONOLOGY <br />Page -2- <br />April 14, 1981 <br />The Division sends Flatiron a Preliminary Adequacy Letter on <br />~~ the Bourg Strip permit application. In part it states "If <br />the applicant wishes to incorporate the Northgate loadout <br />into the permit application at this time..." <br />April 2I, 1981 <br />Inspection of :the Bourg mine site and proposed loadout. Un- <br />permitted disturbance at the Zoadout found. Mr. Ayers, mine <br />superintendent was out of town. Mrs. Ayers accompanied Mr. <br />Savage on the mine site inspection. Mr. Savage told Mrs. Ayers <br />that at least three violations would be issued relative to the <br />disturbances at the Zoadout. <br />April 27, 1982 <br />NOV's 81-14, 81-15, and 81-16 were issued to Walden Coal <br />Company. <br />May 20, 1982 <br />The Division assesses civil penalties for NOV's 81-14, 81-15, <br />and 81-I6 notingthat abatement deadlines had passed and <br />Flatirons had not submitted any of the information required <br />in the abatement section of the violations. <br />May 28, 1981 <br />Inspection of Bourg mine site and proposed loadout by Carol <br />Russell. Zt is noted that the topsoil stockpile has been <br />mulched and seeded, but that heavy equipment damage has not <br />been repaired, and sediment control plans have not been received. <br />June Z7, 1981 <br />An assessment conference is held to discuss violations 81-14, <br />81-15, and 81-16. No agreement is reached. Fred Banta, <br />assessment officer advises Flatiron to submit information as <br />to why the civil penalty amounts are unjustified. <br />June 23, 1981 <br />Flatiron submits additional co7mnents relative to civil penalty <br />assessments for NOV's 81-14, 8Z-15, and 81-16. <br /> <br />
