It was further clarified that this Board Order would replace <br />the current Cessation Order. <br />It was MOPED that the Board convene in Executive Session. SECONDED AND <br />PASSED IIAA.FRMOUSLY (O'Connor, Danielson, Donald, Jouflas, Entz and <br />Cooley). <br />Staff Presentation by Sandra Brown: <br />Petition to initiate formal rule making for the Coal Program. <br />Staff presented ATTACHMENT C - a petition to initiate rule making and <br />asked the Board ~o ins is a the process for rule making. While <br />addressing the packet, Staff related that OSM had received the rules <br />and they asked that same of the rules proposed by the Division be <br />changed. The changes made by the Division will be presented to the <br />Board at the April Board Meeting. Staff will came back to the Board in <br />May for final approval of the proposed rules. <br />It was MOPED that the Board approve the petition and initiate rule <br />making on Fie basis of the statement of basis and purpose provided in <br />Attachment C. DISCUSSION ITEM <br />iscussion a~approval by Board of Coal Program's Guidelines <br />tanagement of various weeds. <br />Staff related that on July 28, 1989, the Division sent all coal <br />operators, Board Members and interested parties a draft policy on the <br />Division's interpretation of rules for the contro] of noxious weeds at <br />mine sites. This was done, because of a need to control these weeds on <br />disturbed areas and to clarify the rules already in place. <br />The Division received numerous comments and held several discussions <br />with industry, in response to the draft policy document. A decision <br />was made to refer to the document as a guideline, rather than a policy <br />document, therefore, proper formal notice would be given, and any <br />subsequent changes made to the guidelines would be need to be approved <br />by the Board. <br />Staff presented ATTACHMENT D - Guideline for the Management of Noxious <br />Weeds on Coal Mine e'~if7~eas and informed the Board that some <br />changes had been made in the document, since its July 28, 1989, <br />distribution. Those changes were discussed. Staff answered questions <br />from the Board. <br />The Board concurred that the Guidelines were ready for implementation. <br />
