Cottony <br />Division Director <br />Natural Resource Trustee <br />Thank you for your letter dated June 28, 2005. As we have discussed, and as you discuss in your letter, due <br />to certain timing problems with the public notice for the Worthing Pit permit amendment application, the <br />public comment period for this application has been extended to August 22, 2005. As a result, the Division <br />of Minerals and Geology (DMG) is considering your letter as being timely filed. As to the issues raised in <br />your letter, the DMG has jurisdiction over the protection of ground water and your water well, and over <br />adverse impacts caused by dust generation. The other issues raised in your letter, truck traffic, noise, and <br />reduced property values, aze not issues that the DMG has authority to consider. Regulatory authority over <br />these subjects is vested with local government. <br />The DMG has investigated the potential for your water well to be impacted by proposed operations at the <br />Worthing Pit. Enclosed with this letter is a diagram constructed from information contained in the permit <br />files for your well maintained by the Office of the State Engineer. Careful examination of the diagram <br />shows that the source of water to your well is isolated from the alluvial aquifer, in which the Worthing Pit is <br />operated. This isolation consists of well casing that is cemented to the surrounding geologic formation, and <br />a barrier of more than 100 foot thickness of relatively impermeable claystone bedrock. The DMG's ground <br />water experts conclude that the Worthing Pit operation will have no impact on the quality and quantity of <br />water pumped from your well. <br />To further investigate the dust issue raised in your letter, the DMG has requested additional information <br />from the applicant. The following quotation is taken from an August 11, 2005 letter from the DMG to <br />i Greystone Environmental Consultants, who aze the permitting consultants for Albert Frei and Sons, Inc.: <br />DMG notes that Exhibit M to the AM-Ol application lists two permits from the Air <br />Pollution Control Division (APCD) as being in effect at the Worthing Pit. DMG views <br />obtaining and being in compliance with all required APCD permits to be an adequate <br />demonstration of sufficient dust control at operations such as the Worthing Pit.
