<br />Minesite Inspection Narrative <br />Page 3 of 3 <br />C-93-036 issued for maintenance of ditches and berms was modified to include <br />the erosion gully on the northern riverbank and the outwash delta below <br />C-93-034 issued for signs and markers modified was modified to include stream <br />buffer markers and topsoil markers <br />C-93-035 issued for culvert maintenance was modified to include Culvert C20 <br />inlet, inlet to D26 and 3 unidentified culverts on the west end of the <br />mine <br />Colorado has approved a revision for the construction of an access road on the <br />west side of the Refuse Disposal Area that did not include an updated map <br />showing the additional disturbed area. It is the position of the representatives of <br />Colorado that this is a permit deficiency that could be addressed without <br />enforcement action. However, regulations specifically require maps that identify all <br />all disturbed areas and as no enforcement action was taken a Ten Day Notice ff93- <br />020-190-001 has been issued to the State of Colorado. <br />This site is covered under a Ten Day Notice (X93-020-352-002 1 of 1) issued to <br />the state on improper permit transfer. This action resulted during an inspection of <br />the Golden Eagle Mine which has the same ownership. <br />During March of this year a Federal Notice of Violation (93-020-352-003 1 of 1) <br />was issued at the New Elk Mine for Failure to construct sediment ponds to the <br />approved design. This violation was issued because the State of Colorado had <br />improperly terminated a violation which had been issued in response to a Ten Day <br />Notice. A deadline of April 25 was set in the notice and as of this inspection no <br />attempt had been made to abate this violation. <br />The underground portion of this mine is not active at this time and openings for the <br />workings have been sealed. At present the preparation plant, loadout area and <br />refuse disposal area are being used to facilitate operations at the Golden Eagle <br />Mine which is under the same ownership. <br />
