<br />~c~J~ VIn~~ S-(~P <br />BEFORE THE MINED LAND RECLAMATION BOARD <br />STATE OF COLORADO <br />ti~h <br />~r c::_1 <br />-`g ~ % 2006 <br />Division of M1d:nzrsls and G~c4c^y <br />FINDINGS OF FACT, CONCLUSIONS OF LAW AND ORDER <br />IN THE MATTER OF RAY AND STEPHANIE SIKES' POSSIBLE NOTICE OF <br />VIOLATION, CEASE AND DESIST ORDER, CORRECTIVE ACTION AND CIVIL <br />PENALTIES FOR MINING WITHOUT A PERMIT, FILE NUMBER M-2005-067 f/ <br />THIS MATTER came before the Mined Land Reclamation Boazd ("Boazd") on <br />January 11, 2006, in Denver, Colorado for a hearing to consider a possible notice of <br />violation, cease and desist order, corrective actions and civil penalties for mining without a <br />permit. The file number in this matter is M-2005-067. Ray and Stephanie Sikes appeazed <br />on their own behalf ("Operator"). Tony Waldron appeazed on behalf of the Division of <br />Minerals and Geology ("Division"). <br />The Board, having considered the parties' presentations and having been otherwise fully <br />informed of the facts in this matter, hereby enters the following findings of fact, conclusions of <br />law and order: <br />The Operator has conducted unpermitted mining operations on a site located in Sections 9 <br />and 16, Township 33 South, Range 50 West, 6`h Prime Meridian, in Baca County, <br />Colorado. The total disturbed area on the site is approximately four acres. <br />Z. The Division inspected the site on October 6, 2005. The Division inspector observed that <br />dimensional sandstone was being excavated from a small quarry on the site. Impacts were <br />limited to the immediate azea of extraction plus an azea around the quarry used to palletize <br />and ship the dimensional sandstone. A small two-track road about one quarter mile in <br />length had been established between the main county road and the quarry. <br />
