Quinn <br />Box 155 <br />Woodland Park, CO 80866 <br />RE: Quinn Quarry (File M-91-147), Apparent Unpermitted Mining Operation <br />Dear Mr. Quinn: <br />On December 18, 1991, we conducted an inspection of your mine and found: <br />evidence of mining in the form of excavations of building stone, rock debris <br />resulting from the excavations and the presence of equipment obviously used in <br />the mining operation. <br />We believe this is in violation of Section 34-32-109 of the Colorado Mined <br />Land Reclamation Act, 34-33-101 ET. SE4. C.R.S. 1973 as amended. <br />Therefore, we have found reason to believe a violation exists to the Law and <br />have scheduled this matter before the Mined Land Reclamation Board. <br />A Formal Public Hearing will be held during the January 22-23, 1992 Board <br />Meeting for consideration of possible violation. The hearing will be held in <br />Room 318 of 1313 Sherman Street, Denver, Colorado, beginning at 9:00 a.m. or <br />as soon thereafter as the matter can be considered, and you will have the <br />opportunity to be represented and heard. It will be reiterated that there is <br />reason to believe that you are in violation of the provisions noted above. <br />If the Board finds a violation at this Hearing, it may issue a cease and <br />desist order and assess a civil penalty in the amount of $50 to 5200 for each <br />day of violation. If you have evidence indicating that the possible <br />violations noted above do not exist or have been corrected, please provide it <br />to us as soon as possible or bring it to the Hearing. <br />At your request, I am enclosing a copy of Rules l.ll, 1.12 and 1.13 of the <br />Mineral Rules and Regulations. Rule l.ll indicates the nature of activities <br />which do not require a reclamation permit from the State. Rules 1.12 adn 1.13 <br />indicate how one may approach the Board and secure an opinion or an Order <br />waiving the requirement for your particular operation to have a mining and <br />reclamation permit. A request for an informal opinion or declaratory order <br />is, however, not necessary in this instance, since this letter does require <br />you to meet with the Board on this issue at their January 22-23, 1992 Meeting. <br />,.S <br />
