The NOV was issued for <br />conducting mining operations on and removing coal from un-eased federal lands without <br />proper State and Federal approvals. <br />The Division's abatement contained three parts. The first two parts were complied with <br />on 9 July 2004. The third part of the abatement requires Bureau of Land Management <br />(BLM) approval of a new (or modified) lease for the area. CCC has submitted a lease <br />modification application and has gone through several rounds of adequacy reviews with <br />BLM. CCC is currently awaiting approval of the lease modification so they can submit a <br />revision to the Division, thereby satisfying part three of the abatement. <br />The current date for the abatement is 16 September 2005. In a letter dated 11 August <br />2005, CCC has requested an additional 90-days to allow adequate time for BLM and <br />Division approvals. CCC's latest request meets the requirements of Rule 5.03.2(2) for <br />approval. <br />I request that you sign the attached NOV extension form, extending the deadline until 15 <br />December 2005.
