The violation was issued November 26, 1996. The initial abatement <br />deadline for the NOV was February 22, 1997. It was then extended to May 23, 1997. Abatement <br />requirements include submittal of a reclamation plan addressing the disturbance associated with <br />RCR 27a, and implementation of the designs approved by DMG. Seneca Coal Company has yet to <br />provide a stability analysis for the road cut. The Division also recently sent out a "Notice and Order <br />to Pay a Fixed Penalty," and has yet to hear from Seneca if they plan to take this action to the Mined <br />Land Reclamation Board. <br />Rule 5.03.2(2)(c) list five circumstances which may qualify a surface coal mine for extension of the <br />abatement deadline beyond 90 days. Seneca has submitted a portion of the reclamation plan for the <br />road cut. The Division is waiting for a stability analysis of the road cut, which will go beyond the <br />90-day abatement. Seneca may also appeal the violation to the Mined Land Reclamation Board. <br />Based on this information, I recommend that you approve the 90-day extension to August 21, 1997. <br />Enclosure <br />c:\wp51\misc\970514 <br />
