<br />The approved drilling operations included a mud pit that was designed and approved <br />prior to drilling. The mud pit was constructed as designed, as noted in the Division's <br />inspection reports. There were no off-site impacts as a result of this violation. <br />Part of the abatement was for Oxbow to submit a Minor Revision (MR-76) to the <br />Division including the borehole on the appropriate map and in the appropriate permit <br />text. This revision was to be submitted by 3 February 2006. Oxbow submitted this <br />revision and it was received by the Division on 2 February 2006. <br />On 8 February 2006 Oxbow submitted a letter to the Division requesting the violation be <br />vacated. I responded to Dave Berry with a letter dated 9 February 2006 and Ron Cattany <br />upheld the violation with a letter to Oxbow on 15 February 2006. There is more detail <br />regarding the violation and permitting chronology in my 9 February 2006 memo to Dave <br />Berry. Additionally, all of the information is in the imaging system. <br />Please ]et me know if you need any additional information regarding this violation or the <br />permitting background.
