>n a westerly direction. 7BM agrees with this reasoning and will
perform all reclamation as per the approved plan.
Violation 80-4C: This violation has been abated.
Violation 80-4d: This violation identifies sediment #10 as riot being
constructed as per the approved plan. It should be noted that sediment
pond #10 as drawn on Exhibit C, said exhibit prepared under the direction
of Robert Reeder, does not exist on map 8009-SCI. Pond #10 has been
replaced by pond 22-P9 and as of this date this pond is >n place.
Violation 80-5a: The topsoil identified in this violation will be reapplied
to the area outlined in NOV 80-4a. This material will be redistributed
6y October 10, 1980. No activity is occurring in this area and the topsoil
is not exposed to any process that might dirtinish i-ts c~iality or
quantity. If mining does occur in the western area before the reworking
of overburden stockpile #4 is ccssiplete t1~en the stockpiled topsoil
will be removed and placed in. topsoil stockpile #1.
Violation 80-Sb: The topsoil continued in the sediment pond dam was
rerroved and placed in the approved topsoil stockpile. The August 29th
su}~ni.ttal contains all the topsoil stockpile except that topsoil
stockpile noted in NOV 80-Sa. This pile was not included due to its
tonporary nature.
Violation 80-Sc': This violation has been abated.
Violation 80-21: 71~is pond has been constructed as of this date.
Violation 80-27-and 80-28: MR&E Inc. is working on these plans and
intends to meet the Cctober 13, 1980 deadline.
Carol, I am very pleased with the progress Trinidad Basin Mining is
making in trying to rectify the mistakes of the past operators. As
noted above, the changed mine plan will have crniplete on the ground
compliance by October 10, 1980. Once 77inidad Basin Mining gets past
the "old problem areas" caused by the previous operators the mining
operator should function much more smoothly and efficiently. I can
freely say that Trinidad Basin will eicamplify good mining and reclamation
practices for.all the other mines >n the area.
TBM and MR&E, Inc. greatly appreciate the understanding exhibited
by both the Division and yourself as TBM works towards cor~leting
on the ground compliance with the regulations. A~ are looking
forward to maintaining this working relationship with the Division
