RE: Civil Penalty Assessment for N.O.V. 83-19
In conference with Sandy Emrich and Bob Liddle of the Ili vision, I have
assessed a civil penalty of $450.00 for Notice of Violation 83-19. This
amount was based on the following assumptions and calculations:

A. History
No violations have been issued to the Blue Ribbon dine during the past
year. Therefore, no assessment was made for history.

B. Seriousness

Seriousness was assessed based on the cost of ~epl~.celnent of the
topsoil that was lost. Topsoil delivered to the site would cost
approximately twenty dollars per cubic yard. the .olwne of topsoil
that was used to repair the embankment of the pond was approximately
ten cubic yards. Two Hundred dollars is, there:fore, assessed for
seriousness of the violation.

G. Fault
The operator was negligent in his duties for usiny topsoil for
reconstruction of the pond embankment. Other, more appropriate
construction material was available nearby. however, reconstruction
was done in haste because of the potential failure of the darn due to
high flows in Hubbard Creek. Therefore, the minimum amount for
negligence of iwo Hundred and fifty dollars i:~ assessed.
