A summary of the history of the NOV follows: <br />• The NOV was issued on May 23, 1994 for failure to make <br />copies of all records available for public inspection. <br />Specifically, the DMG permit was not on file at the <br />County Courthouse. <br />• The operator has stated in the enclosed letter that the <br />DMG permit had been on file in the courthouse, but that <br />it had disappeared in a similar fashion to the way other <br />documents had disappeared in the past. A search through <br />the files revealed that the signed permit document had <br />actually never been returned to the Division by the <br />operator. <br />The permit document was signed by Mike Long in January, <br />1993; however, the operator failed to sign and return the <br />document to the Division. The cover letter sent to the <br />operator with the permit document did not specify that <br />the document should be signed and returned. However, the <br />document itself states that it should be signed and <br />returned. <br />The operator was informed, verbally, in person on June <br />13, 1994 that the permit document had been sent out in <br />January, 1993 and still needs to be signed and returned <br />to the Division. To date, nothing has been received. <br />I would appreciate your expeditious review of this NOV and <br />assessment of a civil penalty by June 22, 1994.
